1. Our Commitment to Copyright
MockingBird AI Inc. (MockingBird) respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.
If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, please follow the procedures outlined below.
2. DMCA Takedown Notice
To file a copyright infringement notification (DMCA takedown notice), you must provide our Designated Agent with the following information in writing:
- Identification of the copyrighted work: Describe the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material: Provide the URL(s) or specific location of the material you claim is infringing, with enough detail for us to locate it.

- Accuracy statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

3. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent with the following:
- Identification of the material: Identify the material that was removed and its location before removal.
- Your contact information: Your name, address, telephone number, and email address.
- Consent to jurisdiction: A statement consenting to the jurisdiction of the federal court in your district (or Delaware if you are outside the US) and agreeing to accept service of process from the party who filed the original DMCA notice.
- Good faith statement: A statement, under penalty of perjury, that the material was removed or disabled as a result of mistake or misidentification.
- Signature: Your physical or electronic signature.
Upon receiving a valid counter-notification, we will provide a copy to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed material.
4. Repeat Infringers
In accordance with the DMCA and other applicable laws, MockingBird maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also limit access to the Service or terminate accounts of users who infringe intellectual property rights, whether or not there is any repeat infringement.
5. Misrepresentation Warning
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees.

6. AI-Generated Content Considerations
Please note that AI-generated images may sometimes resemble existing works due to the nature of machine learning. However, similarity alone does not constitute infringement. We evaluate each DMCA claim carefully and consider:
- Whether the allegedly infringing work is substantially similar
- Whether there is evidence of actual copying
- Whether the use may qualify as fair use or transformative
