Terms ofservice.

The agreement between you and Mockingbird AI when you use our websites, workspaces, subscriptions, credits, and AI design studios.

1. Agreement to these terms

These Terms of Service govern your access to and use of Mockingbird AI, including our websites, AI studios, generation tools, workspaces, subscriptions, credits, templates, exports, and related services.

By creating an account, starting a subscription, purchasing credits, or using the service, you agree to these terms and to any policies referenced here, including our Acceptable Use Policy, Privacy Policy, and Refund and Cancellation Policy.

2. Accounts and customer responsibility

You are responsible for the accuracy of the account, billing, and contact information you provide. You are also responsible for activity under your account and for keeping your login credentials secure.

You must review your selected plan, billing interval, renewal terms, checkout details, and subscription status before completing a purchase or renewal. If you no longer want a subscription, you are responsible for cancelling it before the next renewal date.

3. Subscriptions, renewals, and cancellation

Paid subscriptions renew automatically on the billing cycle selected at checkout unless cancelled before the renewal date. Cancellation stops future renewals, but it does not automatically refund charges already processed.

Each subscription created by a customer is treated as a separate subscription. If you create more than one subscription, each subscription may be billed separately unless it is cancelled before renewal.

You can cancel your subscription through your account billing settings or by contacting support. Access may continue until the end of the paid billing period unless otherwise stated by the plan or required by law.

4. Credits and digital service access

Mockingbird AI uses credits to meter access to generation, editing, export, and workspace features. Credit allowances, refresh rules, rollover rules, and usage costs may vary by plan and feature.

Credits and subscription access are digital services. Once account access, service usage, generation usage, exports, or credits have been provided, payments are generally non-refundable except where Mockingbird AI verifies a billing error, duplicate processing error, or system issue caused by Mockingbird AI or its payment processor.

5. Refunds, duplicate charges, and billing disputes

Our refund and cancellation rules are explained in the Refund and Cancellation Policy. A charge is only considered a duplicate if the same subscription, invoice, or checkout transaction was accidentally charged more than once due to a verified system or payment processing error.

A charge is not considered a duplicate where it relates to a separate subscription created by the customer, a second active subscription, a renewal of an active subscription, or a subscription that was not cancelled before renewal.

If you raise a billing concern, we may review subscription records, Stripe billing records, invoices, account credits, usage history, cancellation history, and support communication before making a decision.

6. Ownership, outputs, and user content

You retain your rights in the prompts, uploads, brand materials, and other content you provide. Subject to these terms and applicable law, you may use outputs generated through Mockingbird AI for personal or commercial purposes.

You are responsible for reviewing outputs before publishing or using them commercially. AI-generated outputs may be similar to outputs generated for other users, may contain errors, and may require human review for brand, legal, regulatory, and platform compliance.

You grant Mockingbird AI a limited license to host, process, transmit, display, and store your content as needed to provide and secure the service, process support requests, and maintain your workspace.

7. Acceptable use

You may not use Mockingbird AI to create illegal content, infringe intellectual property rights, impersonate others, deceive viewers, harass people, generate non-consensual intimate imagery, attempt to bypass safety systems, scrape the service, resell unauthorized access, or violate our Acceptable Use Policy.

8. Service availability and changes

We work to keep Mockingbird AI reliable, but the service may be unavailable, delayed, limited, or changed because of maintenance, provider issues, model availability, payment processor issues, security events, or factors outside our control. We may modify plans, credits, features, models, and pricing prospectively.

9. Suspension and termination

We may suspend or terminate access if you violate these terms, create legal or security risk, misuse credits, attempt payment abuse, file fraudulent disputes, or use the service in a way that may harm Mockingbird AI, other users, or third parties.

10. Disclaimers and limitation of liability

Mockingbird AI is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for claims related to the service is limited to the amount you paid to Mockingbird AI for the service in the 12 months before the claim.

11. Governing law and contact

These terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles, unless a different law is required by applicable consumer protection rules.
