Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (AUP) sets forth the rules and guidelines for using MockingBird AI services. Our goal is to maintain a safe, creative, and respectful environment for all users while enabling the powerful capabilities of AI-powered design.

2. Permitted Uses

MockingBird AI is designed for legitimate creative and commercial purposes, including but not limited to:

• Creating product mockups and marketing materials
• Generating original artwork and illustrations
• Designing social media content and advertisements
• Creating e-commerce product images
• Developing branding and logo concepts
• Generating video content and animations
• Creating educational and informational materials
• Personal creative projects and experimentation

3. Prohibited Content

You may not use MockingBird AI to create, upload, or distribute content that:

3.1 Illegal Content

• Violates any applicable law, regulation, or legal obligation
• Promotes or facilitates illegal activities
• Infringes upon intellectual property rights of others

3.2 Harmful or Dangerous Content

• Promotes violence, terrorism, or harm to individuals or groups
• Contains instructions for dangerous activities or weapons
• Encourages self-harm or suicide

3.3 Child Safety Violations

• Absolutely prohibited: Child sexual abuse material (CSAM) in any form
• Content that sexualizes minors in any way
• Content that exploits or endangers children

Violation of child safety policies will result in immediate account termination and report to authorities.

3.4 Non-Consensual Content

• Deepfakes or synthetic media of real individuals without their explicit consent
• Non-consensual intimate imagery
• Content designed to harass, bully, or intimidate individuals

3.5 Hate and Discrimination

• Content promoting hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Extremist or terrorist propaganda
• Content denying historical atrocities

3.6 Deceptive Content

• Misinformation or disinformation intended to deceive
• Fraudulent or scam-related materials
• Impersonation of individuals or organizations
• Fake news or manipulated media intended to mislead

3.7 Explicit Adult Content

• Sexually explicit or pornographic content
• Graphic violence or gore

4. Prohibited Activities

In addition to content restrictions, the following activities are prohibited:

• Attempting to reverse engineer, decompile, or extract our AI models
• Using automated tools or bots to access the Service beyond approved APIs
• Circumventing rate limits, access controls, or security measures
• Reselling or sublicensing access to the Service without authorization
• Interfering with the Service infrastructure or other user access
• Scraping or harvesting user data
• Creating multiple accounts to circumvent restrictions

5. Intellectual Property

When using MockingBird AI, you must:

• Own or have proper licenses for any images, logos, or brands you upload
• Not infringe on trademarks, copyrights, or other IP rights
• Not create counterfeit goods or pass off generated content as authentic branded products
• Respect the rights of artists and creators when using style references

6. Enforcement

6.1 Detection

We use a combination of automated systems and human review to detect violations. Users may also report violations through our reporting tools.

6.2 Consequences

Violations may result in:

• Warning: First-time minor violations may receive a warning
• Content Removal: Violating content will be removed
• Account Suspension: Temporary suspension for repeated or serious violations
• Account Termination: Permanent ban for severe violations, without refund
• Legal Action: We may report illegal activity to law enforcement

6.3 Appeals

If you believe enforcement action was taken in error, you may appeal by contacting appeals@mockingbirdai.app. Appeals are reviewed within 5 business days.

7. Reporting Violations

If you encounter content or behavior that violates this policy, please report it to abuse@mockingbirdai.app. Include as much detail as possible to help us investigate.

8. Updates

We may update this Acceptable Use Policy as our Service evolves. Material changes will be communicated through the Service or by email. Continued use after changes constitutes acceptance.
